Terms of Service

These Terms of Service govern your access to and use of HABITA's inspection software platform. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
Acceptance of Terms
By creating an account, accessing, or using HABITA, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization.
Account Terms
Account Creation
You must provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You must be at least 18 years old.
Account Security
You are responsible for safeguarding your password and must notify us immediately of any unauthorized access. We are not liable for loss or damage arising from failure to maintain account security.
Account Responsibility
You are responsible for all content created, uploaded, or shared through your account, including inspection data, photos, reports, and client information.
Use of Artificial Intelligence
Unlimited AI and fair use
The Unlimited plan provides uncapped generative AI for normal professional building-inspection use. "No cap" is meant to remove metering and surprise charges, not to permit automated, resold, multi-person shared, or abnormally high usage. We reserve the right to review, temporarily limit, or contact any account whose AI usage volume is clearly unusual (for example scripted use, or usage far exceeding that of a full-time inspector), in order to preserve service quality for all users.
AI credits (Essential plan)
On the Essential plan, generative AI is offered à la carte through credits. Purchased credits do not expire while the account remains active.
Acceptable Use
You agree not to use the Service to:
- •Violate any applicable laws, regulations, or third-party rights
- •Upload or transmit viruses, malware, or other malicious code
- •Attempt to gain unauthorized access to the Service or others' accounts
- •Interfere with or disrupt the Service or servers
- •Harass, abuse, or harm other users
- •Reverse engineer, decompile, or extract source code
Payment Terms
Subscription Plans
HABITA offers various plans with different features and pricing. By subscribing, you agree to pay the associated fees. Subscriptions are billed in advance monthly or annually.
Subscription
The subscription is monthly and without commitment. The first month is free. You may cancel at any time; access remains active until the end of the paid period.
Billing & Renewal
Your subscription auto-renews unless you cancel before renewal. We charge your payment method on file. Keep payment info current.
Price Changes
We may change pricing with at least 30 days' notice. Changes apply to subsequent renewals, not current billing period.
Refunds
Subscription fees are non-refundable except as required by law. On cancellation, you keep access until the end of your billing period.
Intellectual Property
HABITA's Rights
The Service including software, designs, text, graphics, and logos is owned by HABITA and protected by intellectual property laws.
Your Content
You retain all rights to your content. You grant HABITA a limited license to host, store, and process your content solely to provide the Service.
Limitation of Liability
The Service is provided "as is" without warranties. To the maximum extent permitted by law, HABITA shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
Termination
By You
Cancel anytime from account settings. Access continues until end of billing period. Export your data before closure.
By HABITA
We may suspend or terminate your account for Terms violations, non-payment, or harmful conduct. We provide notice when reasonably possible.
Effect
Upon termination, your right to use the Service ceases. We delete account data within 90 days except where required by law.
Electronic Signatures and Communications
Validity of electronic signatures
Service agreements, attestations and other documents delivered through the client portal may be signed electronically. Under Québec's Act to establish a legal framework for information technology (CQLR, c. C-1.1), an electronic signature has the same legal value as a handwritten one. By signing, the client confirms their identity and consent to the document's terms.
Integrity and proof
At the time of signing, a copy of the signed document is frozen and retained, along with a digital fingerprint (hash) that ensures its integrity. The date, time and IP address of each signature are recorded as an audit trail. This information may serve as proof of consent and of the content that was accepted.
Electronic communications
By using the Service, you consent to receiving communications, documents, agreements, invoices and notices electronically (email and client portal). You may withdraw this consent, but doing so may prevent the delivery of certain parts of the Service.
Governing Law
These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada. Disputes shall be resolved in the courts of Montreal, Quebec.
